NATIONAL PERSONAL TRAINING ACADEMY (NPTA™)

TERMS OF SERVICE, REFUND POLICY & FINANCING AGREEMENT

By purchasing, enrolling, or accessing any NPTA™ program, you agree to this legally binding Agreement upon checkout.

1. DEFINITIONS

For the purposes of this Agreement:

“NPTA™” means National Personal Training Academy™ and its affiliates.

“Services” means all digital courses, training programs, materials, and assessments provided by NPTA™.

“Customer”, “Student”, “You” means any individual who purchases or accesses Services.

“Direct Purchase” means a one-time full payment made directly to NPTA™ without financing.

“Learn Now, Pay Later” means a third-party financing arrangement (e.g., Elective) allowing access while paying over time.

“Pay As You Learn” means an in-house installment model facilitated through Elective or similar infrastructure.

“Financing Provider” means any third-party provider facilitating payments or credit approval.

“Access” means ability to view or use any course content, including videos, exams, and downloads.

“Refund” means return of eligible funds under this Agreement only.

“Cancellation” means termination of access; it does not cancel financing unless confirmed by the provider.

“Administrative Fee” means a 5% fee deducted from all approved refunds.

“Exam / Final Assessment” means any final or proctored evaluation within a program.

“5-Day Refund Window” means 5 calendar days from purchase confirmation for eligible Learn Now Pay Later refund requests.

2. SERVICES

NPTA™ provides online education and professional training programs in fitness and personal training.

Programs may include alignment with third-party certification organizations such as NASM. NPTA™ operates independently.

3. ACCOUNT RESPONSIBILITY

You agree to:

• Provide accurate account information
• Maintain confidentiality of login credentials
• Accept responsibility for all account activity
• Notify NPTA™ of unauthorized access

NPTA™ may suspend access for violations or misuse.

4. INTELLECTUAL PROPERTY

All content is owned or licensed by NPTA™ and protected under intellectual property laws.

You are granted a:

• Limited
• Non-exclusive
• Non-transferable
• Revocable

license for personal educational use only.

No copying, resale, or redistribution is permitted.

5. PAYMENTS & FINANCING OPTIONS

NPTA™ offers two financing models. By selecting either, you agree to the terms below.

5.1 Learn Now, Pay Later (Third-Party Financing)

This option is provided through an approved third-party financing provider (e.g., Elective or similar).

General Terms:

• Financing approval is determined solely by the provider
• NPTA™ is not a lender
• Financing agreement is separate from NPTA™ Services

5-Day Cancellation & Refund Window:

You may request cancellation and refund review within 5 calendar days by emailing info@npta.ca.

Eligibility requires:

• Request submitted within 5 days of purchase
• No course content accessed
• No exams or assessments started
• No downloads or materials used

IMPORTANT: INITIAL PAYMENT (NON-REFUNDABLE)

The initial payment is: 

Strictly non-refundable, non-reversible, and cannot be refunded under any circumstances.

Applies even if:

• Cancellation is requested within 5 days
• No content is accessed
• The student changes their mind

If Cancellation Is Approved Within 5 Days:

• Course access will be revoked
• NPTA™ will request cancellation of future payments with the provider
• Financing remains active until confirmed cancelled by provider
• Initial payment remains non-refundable

After 5 Days:

• All purchases are final and non-refundable
• Cancellation requests may be submitted but are not guaranteed
• Financing obligations remain active until confirmed cancelled by provider

5.2 Pay As You Learn (In-House Financing)

This is a structured installment model facilitated through Elective or similar systems.

General Terms:

• Installment-based access model
• Subject to approval and payment verification

Access Conditions:

• Access granted only after 2 successful payments
• No payment = no access
• Missed payments may suspend or revoke access

Refund Policy:

All Pay As You Learn purchases are strictly non-refundable.

No refunds apply under any circumstances, including:

• Partial usage
• Non-completion
• Withdrawal
• Change of mind

Cancellation of Pay As You Learn:

• Access may be cancelled
• Cancellation results in immediate loss of access
• All payment obligations remain enforceable and non-refundable

6. REFUND POLICY SUMMARY

• Learn Now Pay Later → 5-day conditional review window (initial payment non-refundable)
• Pay As You Learn → Strictly non-refundable
• After access or expiry → No refunds apply

7. GENERAL REFUND CONDITIONS (DIRECT PURCHASES ONLY)

This section applies ONLY to Direct Purchases.

It does NOT apply to any financing option.

Where a refund is approved:

• A 5% administrative fee is deducted from all refunds
• Refunds apply only to eligible direct purchases under Section 5.1 conditions
• Refunds are issued to original payment method

Any attempt to apply this section to financing purchases is invalid.

Students enrolled in an NPTA™ Apprenticeship Program are governed by the NPTA™ Apprenticeship Program Cancellation & Refund Policy, which supersedes any conflicting refund, cancellation, or financing provisions contained in these Terms. 

8. REFUND EXCLUSIONS

No refunds will be issued if:

• Final exam or proctored assessment has been attempted
• Final evaluation has been accessed or initiated
• Refund eligibility conditions are not met

9. THIRD-PARTY SERVICES

• NPTA™ uses third-party systems for:
• Learning platforms
• Exams
• Payments
• Financing

NPTA™ is not responsible for third-party failures or policies.

10. NO GUARANTEE OF RESULTS

NPTA™ does not guarantee:

• Certification success
• Employment outcomes
• Income or career advancement

Programs are educational only.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law in British Columbia:

• NPTA™ is not liable for indirect or consequential damages
• Services are provided “as available”
• Liability is limited to amounts paid

12. CONSUMER ACKNOWLEDGEMENT

By completing checkout, you confirm:

• You understand all refund terms
• You understand Learn Now Pay Later includes a 5-day cancellation window
• You understand the initial payment is non-refundable
• You understand Pay As You Learn is non-refundable
• You understand financing remains active until confirmed cancelled by provider
• You agree to this legally binding agreement

13. PRIVACY & DATA PROTECTION

NPTA™ complies with PIPEDA.

Data is used for:

• Account management
• Course delivery
• Payments
• Support

Data is never sold.

14. MARKETING CONSENT (CASL)

You consent to:

• Transactional emails
• Educational updates
• Optional marketing

Unsubscribe anytime.

15. GOVERNING LAW

British Columbia, Canada governs this Agreement.

Disputes are resolved in BC courts.

16. SEVERABILITY

If any section is invalid, the rest remains enforceable.

17. ENTIRE AGREEMENT

This document is the full agreement between NPTA™ and the customer.
